Circular on the Issuance of Nine Guidelines on Integrity for Staff of Medical Institutions

  Provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps Health Care Commission, Medical Security Bureau, Traditional Chinese Medicine Bureau, the National Health Commission, the State Administration of Traditional Chinese Medicine hospitals (management):

  In order to further implement Xi Jinping's ideology of socialism with Chinese characteristics in the new era, enhance the sense of responsibility, mission and honor of healthcare personnel, standardize practice behaviors, promote the professionalism of healthcare personnel in the new era, guide the formation of a clean and upright industry environment, and safeguard the high-quality development of healthcare undertakings, the National Health Commission, the State Medical Insurance Bureau, and the State Bureau of Traditional Chinese Medicine formulated the “Nine Guidelines for Integrity Practice of Healthcare Institutions Staff”. (hereinafter referred to as the Nine Guidelines). They are hereby issued to you and put forward the following working requirements:

  First, strictly implement the main responsibility

  Health administrative departments at all levels (including the Chinese medicine department, the same below) and the leadership of various types of medical institutions at all levels should effectively assume the main responsibility for the implementation of the Nine Guidelines, the implementation of the Nine Guidelines as the implementation of the “management of the industry must be in charge of the style of practice” “whoever is in charge of who is responsible for” important content, study the implementation of the Nine Guidelines as the implementation of “whoever is in charge of who is responsible for”. As an important part of the implementation of “whoever is in charge of the industry must be in charge of the behavior”, the implementation of the “Nine Guidelines” should be taken as the main responsibility. To combine the local reality, focusing on the refinement of the “Nine Guidelines” requirements, to ensure that the standard is clear, feasible measures, appropriate penalties, targeted.

  Second, in-depth study and training

  Health administration and medical insurance departments at all levels, all types of medical institutions at all levels should attach great importance to the study and publicity of the Nine Guidelines, deeply understand the significance of learning the Nine Guidelines in the new era, clarify the relevant requirements, carefully organize and arrange, and rapidly convey the Nine Guidelines to all medical institutions (especially public medical institutions) and every staff member of the medical institutions within the jurisdiction. To incorporate the “Nine Guidelines” into the pre-service education, business training, entry and promotion of pre-training at all levels of practice training and education activities, to ensure full coverage, mobilization, awareness, laying a good foundation for the implementation of the “Nine Guidelines” implementation work.

  Third, effectively strengthen the supervision and implementation

  Health administration and medical insurance departments at all levels should establish a regular supervision mechanism based on the Nine Guidelines, open feedback channels, timely handling of issues, combined with large hospital inspections, medical insurance inspections and other work arrangements, supervise the development and improvement of medical institutions within the jurisdiction to implement the Nine Guidelines of the hospital norms, and timely detection and treatment of violations of the Nine Guidelines requirements. Social supervision should be emphasized, the way of supervision and reporting should be made public, and the clues about the problems of violating the Nine Guidelines reflected by the public with real names should be carefully verified and timely feedback should be given.

  Fourth, resolutely investigate and deal with violations

  Health administration departments at all levels should effectively play the role of the lead unit of the joint mechanism for correcting unethical practices in the field of medicine purchasing and marketing and in medical services, strengthen the coordination and cooperation with medical insurance and other relevant departments, and severely investigate and deal with violations of the Nine Guidelines. For healthcare personnel who violate the Nine Guidelines, depending on the circumstances, the relevant departments will, according to the degree of severity and against the reference penalty, impose administrative sanctions if they violate administrative regulations; if they violate Party discipline, they will be handed over to the disciplinary organs for disciplinary treatment; and if they are suspected of committing a crime, they will be handed over to the judicial organs to be dealt with in accordance with the law. For typical cases, to be regularly informed.

  Fifth, strengthen the rigid constraints assessment

  All localities shall include the implementation of the Nine Guidelines by medical institutions in the evaluation of accreditation and hospital inspections. Health care personnel to implement the “Nine Guidelines” included in the annual assessment of health care personnel, medical ethics assessment and physician regular assessment of the important content, and personal treatment linked. Responsibility for the implementation of the Nine Guidelines should be strictly implemented. If the implementation of the Nine Guidelines is not thorough and leads to serious problems, in addition to holding the parties responsible, the relevant personnel in the health care and health insurance departments and medical institutions should also be held accountable depending on the severity of the situation.

  The Circular of the State Administration of Traditional Chinese Medicine of the National Health and Family Planning Commission on the Issuance of the Nine No-No's for Strengthening the Construction of Medical and Health Care Practices (No. 49 of the State Health Office [2013]) shall be repealed as of the date of the issuance of this Circular.

  The implementation of the Nine Guidelines in each region shall be promptly reported to the NHSC, the State Medical Insurance Bureau and the State Administration of Traditional Chinese Medicine.
